Terms of Service

1. Introduction

These Terms and Conditions ("Terms") govern your use of the Avomart website at https://avomart.co.za ("Website") and any purchases made through it. Avomart is the online store operated by SterlingPro (Pty) Ltd. By using the Website or placing an order, you agree to be bound by these Terms.

These Terms comply with the Electronic Communications and Transactions Act 25 of 2002 ("ECT Act"), the Consumer Protection Act 68 of 2008 ("CPA"), and the Protection of Personal Information Act 4 of 2013 ("POPIA").

3. Products and pricing

All prices on the Website are quoted in South African Rand (ZAR) and include VAT where applicable, unless otherwise stated. Delivery fees, where applicable, are calculated at checkout and displayed before you place an order.

We make every effort to ensure that product descriptions, prices, and images are accurate. However, errors may occur. If we discover an error in the price of products you have ordered, we will contact you as soon as possible to give you the option of reconfirming the order at the correct price or cancelling it. If we are unable to reach you, the order will be treated as cancelled and any payment received will be refunded in full.

Availability of products is subject to stock. We reserve the right to limit quantities, refuse orders, or discontinue products at our discretion.

4. Orders and acceptance

Submitting an order constitutes an offer to purchase. A binding contract of sale comes into existence only when we send you an order confirmation email after successful payment. We reserve the right to decline any order, in which case we will refund any payment received.

Before placing your order, you will have the opportunity to review your entire order, correct any mistakes, and withdraw from the transaction, in accordance with section 43(2) of the ECT Act.

5. Payment

We accept the payment methods displayed at checkout. Payments are processed through Shopify Payments and other payment service providers that comply with PCI-DSS and other applicable security standards, in line with section 43(5) of the ECT Act. We do not store full credit card details on our systems.

6. Delivery

Delivery is fulfilled through Bob Go and its courier partners. Estimated delivery times are provided at checkout and are estimates only — they are not guaranteed. Delivery is to the address you provide at checkout. Risk in the goods passes to you on delivery.

7. Cooling-off period (ECT Act s.44)

You have the right to cancel an electronic transaction without reason and without penalty within 7 (seven) calendar days of:

  • the date you receive the goods, in the case of goods; or
  • the date the agreement is concluded, in the case of services.

To exercise this right, email support@avomart.co.za within the 7-day period. You must return the goods in their original, unused condition and packaging at your own cost. We will refund the purchase price (excluding original delivery costs) within 30 days of receiving the returned goods, in accordance with section 44 of the ECT Act.

The cooling-off right does not apply to:

  • goods made to your specifications or personalised;
  • perishable goods;
  • goods that have been unsealed or that cannot be returned for hygiene reasons;
  • newspapers, periodicals, magazines and books;
  • any other category of goods or services excluded under section 42(2) of the ECT Act.

8. Defective or non-conforming goods (CPA s.55–56)

In accordance with section 55 of the CPA, you have the right to receive goods that are reasonably suitable for the purpose for which they are intended, of good quality, in good working order, and free of defects.

If, within 6 (six) months of delivery, the goods are found to be defective, unsafe, or fail to meet the standards required by the CPA, you may return them at our cost and, at your election, receive:

  • a repair of the goods;
  • a replacement of the goods; or
  • a full refund of the purchase price.

This right is in addition to any manufacturer's warranty. Please refer to our Refund Policy for the returns process.

9. Use of the Website

You agree not to use the Website for any unlawful purpose, to infringe any intellectual property rights, to upload malicious code, to attempt to gain unauthorised access to any system, or to interfere with the operation of the Website.

All content on the Website — including text, images, logos, and software — is owned by SterlingPro (Pty) Ltd or its licensors and is protected by copyright and trade mark laws. You may not reproduce, distribute, or create derivative works without our prior written consent.

10. Limitation of liability

To the maximum extent permitted by law, SterlingPro (Pty) Ltd shall not be liable for any indirect, incidental, consequential, or special damages arising out of or in connection with your use of the Website or any goods purchased through it. Nothing in these Terms limits or excludes any liability that cannot be limited or excluded under the CPA or other applicable law.

11. Privacy

Your personal information is collected and processed in accordance with our Privacy Policy, which forms part of these Terms.

12. Dispute resolution

If you have a complaint, please contact us first at support@avomart.co.za so we can try to resolve it directly.

If we are unable to resolve a dispute, you may refer the matter to the Consumer Goods and Services Ombud (www.cgso.org.za) or the National Consumer Commission (www.thencc.gov.za). You may also approach a competent South African court.

13. Governing law and jurisdiction

These Terms are governed by the laws of the Republic of South Africa. You consent to the jurisdiction of the South African courts.

14. Changes to these Terms

We may amend these Terms from time to time. The version published on the Website at the time you place an order applies to that order. Continued use of the Website after changes are published constitutes acceptance of the amended Terms.
